Welcome to dexterity.ai (the “Site”), owned and operated by Dexterity, Inc. (“Dexterity,” “we,” or “us”). By using this Site, you agree to these terms and conditions of use (the “Terms”); if you do not agree, you may not use the Site. Dexterity may modify the Site and/or these Terms from time to time without notice to you, except that if Dexterity makes material changes to these Terms, we will post the revised Terms and the revised effective date on this Site and/or provide notice by some other means. By using the Site following any modifications to the Terms, you agree to be bound by the modified Terms. The Terms do not govern use of any of Dexterity's services, which are subject to a separate services agreement to be signed between any user of the services and Dexterity.
1. Use of the Site
You must be at least 16 years old to use our Site. We do not knowingly collect or solicit personally identifiable information from individuals under 16. If you are under 16, please do not attempt to use the Site or send any personal information about yourself to us. If we learn we have collected personal information from an individual under 16, we will delete that information as quickly as possible. You will comply with all applicable laws, rules and regulations in connection with your use of the Site. You will not violate or attempt to violate the security of the Site or Dexterity's systems or network security, including, without limitation by (i) accessing data not intended for users of the Site or gaining unauthorized access to an account, server or any other computer system; (ii) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures; (iii) attempting to interfere with the function of the Site, host or network. You may not “crawl,” “scrape,” or “spider” any portion of the Site (through use of manual or automated means).
2. Information Not Confidential
If you choose to contact any Dexterity personnel using the contact information you find on the Site, you understand any information and/or materials you provide to such personnel will not be treated as confidential or proprietary. Dexterity undertakes no obligation to review information submitted by you, or to return such information to you.
3. Dexterity Proprietary Rights
The Site, including all of its contents (including, text, images, audio, and the HTML used to generate the pages) (“Content”), are the property of Dexterity or that of our suppliers or licensors and are protected by trademark, copyright, and/or other intellectual property laws. You may not download, copy, print, display, perform, reproduce, publish, modify, prepare derivative works from, license, transmit, or distribute any Content from this Site in whole or in part, for any public or commercial purpose without prior written consent from Dexterity. Dexterity grants you a limited, personal, non-exclusive, non-transferable license to access the Site, and to use the Content, solely for personal, internal and non-commercial purposes. Dexterity (on behalf of itself and its suppliers and licensors) reserves all rights not expressly granted herein.
Without limiting the foregoing, as between you and Dexterity, Dexterity is the owner and/or authorized user of any trademark, registered trademark, logo, and/or service mark appearing on the Site (the “Marks”). Nothing on the Site should be construed to grant any license or right to use any Dexterity Mark. You may not use or exploit any Marks without prior written consent from Dexterity.

Sources of Personal Data
You: When you provide such information directly to us; when you voluntarily provide information to us, including in free-form text boxes; when you send us an email or otherwise contact us. When you use the Services and such information is collected automatically through Cookies, analytics or tracking tools placed on the Site. If you use a location-enabled browser, we may receive information about your location.
Third Parties / Vendors: We may use analytics providers to analyze how you interact and engage with the Site.
Our Commercial or Business Purposes for Collecting Personal Data
Providing, Customizing and Improving the Site and Dexterity's products and services: Improving our products and services, including testing, research, internal analytics and product development. Doing fraud protection, security and debugging. Carrying out other business purposes stated when collecting your Personal Data or as otherwise set forth in applicable data privacy laws, such as the California Consumer Privacy Act (the “CCPA”).
Marketing Dexterity's products and services: Marketing and selling our products and services.
Corresponding with You: Responding to correspondence that we receive from you, contacting you when necessary or requested, and sending you information about Dexterity or our products and services. Sending emails and other communications according to your preferences or that display content that we think will interest you.
We will not collect additional categories of Personal Data or use the Personal Data we collected for materially different, unrelated or incompatible purposes without providing you notice.
How We Share Your Personal Data
We disclose your Personal Data to the third parties and for the purposes or under the conditions described in this section:
Service Providers: These parties help us perform business functions on our behalf. They include hosting, technology and communication providers; security and fraud prevention consultants; support and customer service vendors.
Advertising Partners: These parties help us market our services and provide you with other offers that may be of interest to you. They include ad networks, data brokers, and marketing providers.
Analytics Partners: These parties provide analytics on web traffic or usage of the Site. They include companies that track how users found or were referred to the Site, and companies that track how users interact with the Site.

All of your Personal Data that we collect may be transferred to a third party if we undergo a merger, acquisition, bankruptcy or other transaction in which that third party assumes control of our business (in whole or in part). Should one of these events occur, we will make reasonable efforts to notify you before your information becomes subject to different privacy and security policies and practices.
Data that is Not Personal Data
Dexterity may freely use information or data that is not Personal Data for its business purposes, and may disclose such information, in a form that does not personally identify you, to any other person or entity. We may share statistical or aggregated non-personal information about our users with advertisers, business partners, sponsors and other third parties. This data is used to customize Dexterity website content and advertising to deliver a better experience to our users. Dexterity may occasionally send you marketing information like updates on promotions and events relating to products and services offered by us where we have assessed that it is beneficial to you as a customer and in Dexterity' interests; if you do not want to receive further emails from us, please click the “unsubscribe” link in any such message.
Additional Information about Cookies
The Site use cookies and similar technologies such as pixel tags, web beacons, clear GIFs, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Site, to analyze trends, learn about our user base and operate and improve our Site. Cookies are small files — usually consisting of letters and numbers — placed on your computer, tablet, phone, or similar device when you use that device to visit our Site. Interest-Based Advertisements
We may serve advertisements, and also allow third party ad networks, including third party ad servers, ad agencies, ad technology vendors and research firms, to serve advertisements through the Site. These advertisements may be targeted to users who fit certain general profile categories or display certain preferences or behaviors (“Interest-Based Ads”). Information for Internet-Based Ads (including Personal Data) may be provided to us by you, or derived from the usage patterns of particular users on the Site and/or services of Third Parties. Such information may be gathered through tracking users' activities across time and unaffiliated properties.
We comply with the Digital Advertising Alliance (“DAA”) Self-Regulatory Principles for Online Behavioral Advertising. Through the DAA and Network Advertising Initiative (“NAI”), several media and marketing associations have developed an industry self-regulatory program to give consumers a better understanding of and greater control over ads that are customized based on their online behavior across different websites.

The Site may contain links to third party websites (“Third Party Sites”). Third Party Sites are not reviewed, controlled or examined by Dexterity in any way and Dexterity is not responsible for any content contained therein. These links do not imply Dexterity' endorsement of or association with any Third Party Site. Dexterity is not liable, directly or indirectly, to anyone for any loss or damage arising from or in connection with use of the Third Party Sites.
Data Security and Retention
We seek to protect your Personal Data from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of Personal Data and how we are processing that data. Although we work to protect the security of your data that we hold in our records, please be aware that no method of transmitting data over the internet or storing data is completely secure.
We retain Personal Data about you for as long as necessary to provide you with information about our products and services. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.
California Resident Rights
Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for such third parties' direct marketing purposes; in order to submit such a request, please contact us at privacy@dexterity.ai.
Nevada Resident Rights
If you are a resident of Nevada, you have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. You can exercise this right by contacting us at privacy@dexterity.ai with the subject line “Nevada Do Not Sell Request” and providing us with your name. We will not and do not sell your Personal Data.

THE SITE, INCLUDING, WITHOUT LIMITATION, ALL CONTENT AND FUNCTIONALITY THEREOF, IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. DEXTERITY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND. DEXTERITY DOES NOT WARRANT THAT USE OF THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. NO ADVICE, INFORMATION OR MATERIALS, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU THROUGH THE SITE WILL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN.
6. Limitation of Liability
TO THE GREATEST EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT WILL DEXTERITY, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES OF ANY KIND (INCLUDING, BUT NOT LIMITED TO, LOSS OF REVENUE, INCOME OR PROFITS, LOSS OF USE OR DATA, LOSS OR DIMINUTION IN VALUE OF ASSETS OR SECURITIES, OR DAMAGES FOR BUSINESS INTERRUPTION) ARISING OUT OF OR IN ANY WAY RELATED TO THE ACCESS OR USE OF THE SITE OR OTHERWISE RELATED TO THESE TERMS, REGARDLESS OF THE FORM OF ACTION, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF DEXTERITY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE MAXIMUM TOTAL LIABILITY OF DEXTERITY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS TO YOU FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION SHALL NOT EXCEED $100.00 IN THE AGGREGATE.
7. General Information
These Terms are governed by and construed in accordance with the laws of the State of California, United States of America, without regards to its conflict of law provisions. You agree to submit to personal jurisdiction in the state and federal courts located in San Mateo County, California, and any cause of action that relates to these Terms or the Site must be filed therein. If any provision of the Terms is found to be unlawful, void, or for any reason unenforceable, then that provision will be limited to the minimum extent necessary, and will not affect the validity and enforceability of any other provisions. Dexterity's failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The Terms constitutes the entire agreement between you and Dexterity and supersedes all prior agreements between you and Dexterity. You may not assign, delegate or transfer these Terms, by operation of law or otherwise, without Dexterity's prior written consent.
